Fake Dowry Case - Women held for forgery and criminal conspiracy..

 

A woman who allegedly attempted to implicate her husband in a dowry case, has herself been booked after a magisterial court directed the police to register an FIR against the woman and her family for giving dowry.

The order of the court came while hearing to a petition of complainant Manish Kumar against his wife Pratibha and his

in-laws, who had accused him of demanding dowry prior to and after marriage. .The SHO of the concerned police station is directed to register FIR as per the law and ensure the matter is properly investigated., said Judicial Magistrate, Gautam Budh Nagar in Noida. 
In the petition filed through his counsel Pradeep Nawani, Manish had alleged that his wife, who had estranged him within six months of their marriage, had tried to implicate him in a false case and that the list of dowry articles was forged and fabricated. Pleading before the court, Nawani submitted that Pratibha had illegitimately been demanding for brand new car from her husband and also threatened to implicate him in false case of dowry if the demand was not fulfilled. He further alleged that the petitioner was also threatened by his in-laws when he went to them to know the whereabouts of his wife.

Earlier, the woman had approached the Crime Against Women (CAW) cell of Delhi police alleging that her husband his family had been demanding dowry even after marriage.

Following this an FIR was lodged with Dwarka police station under sections 498 (A), 404 and 34 of the Indian Penal Code that deal with subjecting a woman to cruelty by her husband or inlaws. The petitioner said that he had also petitioned before the SSP of Noida in this regard, but feeling aggrieved he approached the court alleging that his wife and her family had also committed an offence by giving dowry. “Keeping in view the facts produced before the court, I am of the opinion that prima facie an offence has been committed”, the Magistrate said while directing the SHO, Sector-39 police station to register the case.

The petitioner Manish Kumar and his wife Pratibha, both software engineers, got married in December 2004, and had been living together in Noida. The petitioner said that the dispute between them arose because of the excessive parental interference, which prompted her to leave him. 
The woman had alleged that her parents had already given dowry articles worth Rs 24 lakh but she was still being subjected to cruelty demanding more money. Meanwhile, the police have registered a case against the woman and her family members under section 3 of the Dowry Prohibition Act for giving dowry, and sections 285, 389, 506 and 120 (B) of Indian Penal Code that deal with extorting money, criminal intimidation and criminal conspiracy.
